Abstract

يعتبر كتاب محاسن الشريعة من المؤلفات المقاصدية، لكن عند مطالعته نجد أن هذا الكتاب قد اعتمد على مقولات الفلسفة المدنية، دون وجود مسوغ لذلك. وهنا نطرح السؤال التالي: مالذي دفع القفال إلى تبني الفلسفة المدنية في إثبات مقصدية الشريعة؟ وقبل ذلك ما دخل التحضر في نشأة العلوم؟ وهل كان له دور فيما قام به القفال في كتابه محاسن الشريعة؟ ويهدف هذا البحث إلى الوقوف على كيفية تشكل مقاصد الشريعة عبر مراحل تطوره، واعتمدت لتحقيق هذا الهدف خطة قسمت من خلالها البحث إلى مقدمة ومبحثين، وسمت الأول بعنوان التحضر وعلاقته بالعلوم والثاني بعنوان التحضر ودوره في بلورة محاسن الشريعة، وتوصلت من خلاله إلى أن التحضر جعل القفال يربط المقاصد بالفلسفة المدنية، والتي تمثل خلاصة ما أنتجه العقل في التنظير للحضارة زمن القفال. What prompted Al-Qaffal to adopt civil philosophy in proving the purpose of Sharia law, and extracting the objectives from the rulings he treated? This research aims to identify one of the nutrients of the study of Maqasid al-Sharia through the stages of its development. I divided the research into an introduction and two sections. The first was entitled Civilization and its relationship to the sciences, and the second was entitled Urbanization and its Role in Crystallizing the Virtues of Sharia. Through it, I concluded that urbanization made Al-Qaffal link Maqasid with civil philosophy. , which represents a summary of what the mind produced in theorizing about civilization at the time of Al-Qaffal.
