الاحتياط وتطبيقاته عند الشيخ أحمد حماني من خلال فتاويه في الأحوال الشخصية

Abstract

الاحتياط أصل يعتمد عليه الفقهاء في أحوال عديدة؛ كقيام الشبهة المعتبرة، أو الخروج من الخلاف، أو الترجيح، وما شابه ذلك، ولما كان المالكية أكثر المذاهب إعمالا لهذا الأصل، كان هذا البحث يُعنى ببيان مكانة الاحتياط عند أشهر من تقلد منصب الإفتاء بالجزائر في العصر الحديث، ألا وهو الشيخ أحمد حماني (ت 1419هـ) ويعنى كذلك ببيان مدى اعتماده عليه في فتاويه المتعلقة بالأحوال الشخصية، مقدمًا للموضوع بذكر مفهوم كل من الاحتياط، والأحوال الشخصية، وذكر ترجمة مختصرة للشيخ، وقد خلصت إلى أن المنزع الاحتياطي عند الشيخ كان واضحا، فقد اعتمد عليه كثيرا في فتاويه، وبخاصة في الأحوال الشخصية، وذكرت شواهد توضح ذلك. Precaution is a principle relied upon by jurists in many situations, such as the presence of a valid doubt, resolving differences, or making preferences, and similar matters. Since the Maliki school of thought is the most engaged in this principle, this research focuses on clarifying the status of precaution according to one of the most prominent figures in the field of fatwa in modern Algeria, namely Sheikh Ahmed Hamani (d. 1419 AH). It also aims to illustrate the extent of his reliance on it in his fatwas related to personal status, beginning with a mention of the concept of both precaution and personal status, along with a brief biography of the Sheikh. The conclusion reached is that the precautionary inclination in the Sheikh's work was evident, as he relied on it significantly in his fatwas, especially concerning personal status, and examples were provided to illustrate
