البعد المقاصدي في تشريعات التهيئة العمرانية لدى فقهاء المالكية

Abstract

يهدف هذا البحث إلى بيان أمرين: أولا : بيات أن الفقه المالكي فقه حضاري، يتطور بتطور الزمان والمكان، وذلك لما له من مصادر خاصة يغلب عليها الفقه المقاصدي، و خاصة عند غياب النص التشريعي التفصيلي على نحو موضوع هذا البحث. ثانيا: بيان أن علماء المذهب المالكي كانت لهم إسهامات في التشريع العمراني والبناء منقطعة النظير، وخاصة في مجال التهيئة العمرانية وإن كانت تلك التشريعات تتناسب وبيئتهم التي عاشوا فيها. This study aims at explaining ,in one hand ,that the Malekki Fiqh is an update Fiqh For its exceptional sources that are plainly over whelmed by The Maqasidi Fiqh, especially in the absence of the detailed legislative text, the main concen treated in this work , and demonstrating that the MaleKKi scholars had great contributions in terms of all legistations in relation to architecture , building and design though being limited to their environment on .the other hand
