الوسطية في فتاوى المرأة في الفقه المالكي

Abstract

تبرز أهمية دراسة الوسطية في فتاوى المرأة في المذهب المالكي باعتباره مرجعية بلدنا ولتميزه بالاتزان والاعتدال في معالجة قضايا الإنسان والمجتمع مراعيا في ذلك مقاصد الشريعة وروحها في اسقاط الأحكام الشرعية على واقع الناس جميعا ... وذلك بالإجابة على السؤال الآتي : كيف تجلت الوسطية في الفقه المالكي عند معالجة قضايا المرأة والفتاوى المتعلقة بها ؟ مما يقتضي الاجابة على التساؤلات الفرعية الأتية : ما لمقصود بالوسطية لغة واصطلاحا؟ وما مفهومها في الفقه عموما و في الفقه المالكي خصوصا ؟ وما مظاهرها في الفتاوى المتعلقة بالمرأة ؟ وخلصت الدراسة إلى أنّ الفقه المالكي عالج قضايا المرأة بكل اعتدال وتوزان بما يحفظ حقوقها ومصالحها في كل الميادين، صلاحية الفقه الإسلامي عموما والمالكي خصوصا لكل زمان ومكان لتميزه بخاصية الوسطية المبنية على تفعيل مقاصد الشريعة الإسلامية في كل المجالات ولكل النّاس . The importance of studying moderation in women's legal rulings within the Maliki school of thought is highlighted by its status as the primary reference point in our country and its distinctive balance and moderation in addressing human and societal issues. This approach considers the objectives and spirit of Islamic law (Sharia) in applying legal rulings to the realities of all people. This can be achieved by answering the following question: How is moderation manifested in Maliki jurisprudence when addressing women's issues and related legal rulings? This necessitates addressing the following sub-questions: What is meant by moderation linguistically and technically? What is its concept in jurisprudence in general and in Maliki jurisprudence in particular? And how is it manifested in legal rulings concerning women? The study concludes that Maliki jurisprudence addresses women's issues with complete moderation and balance, safeguarding their rights and interests in all spheres. Islamic jurisprudence in general, and Maliki jurisprudence in particular, remains relevant for all times and places due to its characteristic moderation, which is based on activating the objectives of Islamic law in all areas and for all people.
