تنزيل حقيقة الدلالة لموجب الجمع بين الأدلة عند المالكية تأصيلا وتفريغا ونماذج من المدرسة الكنتية

Abstract

من أصول المالكية تقديم الحقيقة الشرعية على الحقيقة اللغوية، إلا إنه وجدت بعض الفروع التي تخالف هذه القاعدة، أعني إنهم في بعض الأحيان - يقدمون الحقيقة اللغوية عن الحقيقة الشرعية، وهو ما سميته بـ"تنزيل حقيقة الدلالة"، وهذا البحث يجيب عن السبب الذي جعل المالكية يتجهون هذا الاتجاه في بعض تفريعاتهم الفقهية، ألا وهو الجمع بين الأدلة، وذلك باستعراض مجموعة من الجزئيات من تراثهم عموما، ثم من تراث المدرسة الكنتية خصوصا، ودراستها وإبراز علاقتها بموضوع البحث Amongst the founding rules of the Malakite jurisprudential (when processing & applying the statements), there is the fact of putting ahead the technical meaning instead of the denoted meaning. However, one might find in some cases the opposite, where by the denoted meaning was adopted in comparison with the technical meaning which has allowed me to choose the following title “The descent of the technical meaning”. This presentation highlights the reasons that led the scholars of the Malakite School of thoughts to move towards this direction in some application of the jurisprudential rules. The jurisprudential rules request to collect & analyse the arguments of the same subject to the maximum extent. My work consisted on collecting a sufficient number of ramifications of this heritage Malakite in general, and in specially the heritage of the “Kounta” school to study them & demonstrate the relationship to this theme.
