قراءة في مخطوط تحفة الوارد في اختصاص الشرف من قبل الوالد لابن قنفذ القسنطيني

Abstract

تأتي هذه الدراسة لتغطية جزء من الإنتاج المعرفي لعلماء المغرب الأوسط عامة وعلماء قسنطينة خاصة، كون ابن القنفذ من أشهر أعلامها الذين نبغوا وتفننوا في فن الكتابة والتأليف. إن مخطوط تحفة الوارد جاء ليميط اللثام عن مسألة شائكة نتج عنها اختلاف وتضارب في الآراء بين الفقهاء حول مسألة النسب الشريف، ومن هنا جاء دور الفقيه والعلامة ابن قنفذ ليحسم الأمر في هذا الاختلاف ويقيم الحجة والدلائل على ضرورة نسب الابن لأبيه في كل الحالات، وهذا ما سأتطرق إليه بالتفصيل في هذه الورقة البحثية This study comes to cover part of the knowledge production of the scholars of the Middle Maghreb in general and the scholars of Constantine in particular, the fact that Ibn al-Qunfudh is one of its most famous figures who excelled and excelled in the art of writing and composition. The Tuhfat al-Ward manuscript came to reveal a thorny issue that resulted in a difference and conflict of opinions among the jurists on the issue of honorable lineage, hence the role of the jurist and scholar Ibn Qunfuth to resolve the matter in this difference and establish the argument and evidence for the necessity of attributing the son to his father in all cases, and this is what I will discuss it in detail in this research paper
