حياء المرأة بين النص الشرعي ورؤية الفكر النسوي المعاصر

Abstract

يستهدف البحث بيان رؤية الفكر النسوي المعاصر الحياء المرأة في الإسلام، حيث برز هذا الفكر منتقدا نصوص القرآن والسنة والأحكام الشرعية التي استنبطها الفقهاء الداعية إلى الحياء بدعوى ظلم الإسلام للمرأة، وتقييد حريتها، ما أدى بهذا الفكر إلى رفض كثير من مظاهر حياء المرأة ووسائله، ويشتمل البحث على تعريف الحياء، وبيان النصوص الشرعية الدالة عليه، وتحلية الرؤية النسوية الحياء المرأة واعتراضاتها عليه، وتفنيد هذه الرؤية في ضوء قواعد فهم النصوص الشرعية ونقدها. The research aims to show the vision of contemporary feminist thought of women's modesty in Islam, where this thought emerged criticizing the texts of the Qur'an and Sunnah and the legal provisions devised by jurists calling for women's modesty under the pretext of Islam's injustice to women, and restricting their freedom, which led this thought to reject many manifestations of women's modesty and its means, and the research deals with the definition of modesty and the statement of legal texts indicating women's modesty, and the manifestation of the feminist vision of women's modesty and objections to it, and criticism of this vision in the light of the rules of understanding and criticism of legal texts.
