أثر البيئة في تغير الفروع وطرق التأصيل المذهب الحنفي والمدرسة العراقية المالكية نموذجا

Abstract

تحدثت في هذا المقال حول أثر البيئة على التفريعات والتقعيدات والتأصيلات؛ وذلك من خلال دراسة خصائص المذهب الحنفي والمدرسة المالكية العراقية الذين جمعتهما البيئة العراقية؛ حيث بدأت بالتعريف بالمذهب المالكي والمدرسة المالكية العراقية ثم تطرقت إلى أهم الخصائص التي تميز بها كل من المذهب الحنفي والمدرسة المالكية؛ خاصة ما يتعلق بأثر البيئة عليها في تشابه الأصول والتفريعات؛ فكانت متقاربة ومتشابهة لحد كبير في الأسماء والمصطلحات مع وجود بعض الفوارق في نسبة الاستعمال لذلك الأصل أو ذاك. فخلصت في النهاية إلى أن البيئة تؤثر تأثيرا قوياً ومباشراً على تأصيل الأصول والفروع حتى ولو تطلب الأمر الخروج من الأصول العامة للمذهب مراعاة للظروف والمعطيات المطروحة In this article, I spoke about the impact of the environment on exaggerations, speculations and details, through the study and characteristics of the Hanafi and Maliki schools, which were collected by the Iraqi environment; Where I began to define the Maliki school and Maliki's Iraqi school.
