مفهوم حماية الصحفي في ظل القانون العضوي رقم 23-14 المتعلق بالإعلام - دراسة وصفية تحليلية

Abstract

يشكل موضوع حماية الصحفي كمعطى قانوني في التشريعات الإعلامية إشكالية بحثية غاية في الأهمية لارتباطها بعدة أبعاد اجتماعية، اقتصادية مهنية تنظيمية فكرية وكذا لعلاقتها المباشرة بالممارسة الصحفية وهو ما يجعل من هذا الموضوع موضوعا للنقاش بين الممارسين والباحثين ورجال القانون. سنحاول من خلال دراستنا تحليل المعالجة القانونية التي جاء بها القانون العضوي رقم 23-14 المتعلق بالإعلام من مواد تهدف إلى حماية الصحفي من عدة جوانب مهنية وفكرية ومادية وجسدية اعتمدنا في دراستنا على المنهج الوصفي التحليلي للمواد المتعلقة بالفصل الثاني من هذا القانون العضوي والمعنون بـ: حماية الصحفي والذي تضمن 11 مادة، ومن خلال تحليل مواد هذا القانون استنتجنا أن المشرع الجزائري حاول أن يغطي جميع الأبعاد المرتبطة بمفهوم حماية الصحفي. The problematic based on protection of journalist in media legislation is a very primordial research problematic ; it is related to many dimensions (social, economic, professional, organizational, intellectual) and its linked directly to the journalistic practice ; which makes this topic a subject of discussion (practitioners, researchers and jurists). This study tries to analyze the articles of organic law No 23-14 related to protection of journalist from several parts (professional, intellectual, economic and physical). We relied on the descriptive and analytical approach to analyze the articles of the second chapter of this organic law: Journalist Protection, which included 11 articles, we concluded that the Algerian legislator tried to cover all dimensions of protection of journalist.
