التكريس القانوني للحق في الماء في الجزائر

Abstract

إن مسألة الحصول على المياه الصالحة للشرب حقا من الحقوق الأساسية لكل انسان وتعمل الدولة على توفيرها بالكمية والنوعية اللازمين، لذلك اعتنى المشرع الجزائري بموضوع المياه من خلال جملة من التشريعات بداية من القانون 83_17 الصادر في 16 جويلية 1983 المتعلق بالمياه، ووصولا الى القانون 05_12 المؤرخ في 04 اوت 2005 المتعلق بالمياه والذي نص على أن الحصول على المياه وعلى التطهير حق، ليتم التكريس الدستوري لهذا الحق لأول مرة بموجب المادة 63 من التعديل الدستوري لسنة 2020. إن هذا التكريس يتطلب ضمان حماية قانونية للمياه واستدامتها من جهة، ومن جهة أخرى ضمان التمتع بها والانتفاع بها باعتبارها حق طبيعي لكل شخص بدون تمييز. Access to potable water is a fundamental human right, and the state works to provide it in the necessary quantity and quality. Therefore, the Algerian legislator has addressed the issue of water through a series of laws, starting with Law 83-17 issued on July 16, 1983, concerning water, and culminating in Law 05-12 dated August 4, 2005, also concerning water, which stipulated that access to water and sanitation is a right. This right was enshrined in the constitution for the first time under Article 63 of the 2020 constitutional amendment. This enshrining requires guaranteeing legal protection for water and its sustainability, on the one hand, and on the other hand, guaranteeing its enjoyment and use as a natural right for every person without discrimination.
