Abstract

إن التحرش الجنسي هو نوع من أنواع العنف الجنسي الممارس ضد المرأة والذي يتحلى في صور وأشكال عديدة، ولكن ما يمكن أن نقره هو أنه سلوك جنسي غير مرغوب فيه هدفه إشباع الرغبات الجنسية عن طريق ممارسات تشعر المرأة بالاستياء، حيث نلاحظ أن المشرع الجزائري لم يعط تعرفا واضح التضاريس لتعريف جريمة التحرش الجنسي بل اكتفى بالنص على الأفعال التي تشكل هاته الجريمة وكذا عقوبتها، بالإضافة إلى أن المشرع الجزائري حصر الفعل وحرمه في فضاء العمل من خلال نص المادة 341 مكرر وأجازه فيما دون ذلك، وهنا يتعارض القانون مع ما يتوفر داخل العلبة الاجتماعية..
