التخريج الفقهي للنوازل عند البرزلي (841هـ) : التخريج على القواعد الفقهية أنموذجا

Abstract

التخريج الفقهي آلية مهمة يرتكز عليها الفقيه في استنباط أحكام المسائل المستجدة والنازلة التي لم يجد لها نص يهتدي به إلى حكمها، لا سيما بعد انقضاء عصر الأئمة المجتهدين، لذا نجد أن أكثر أنواع التخريج المعتمدة في كتب الفتاوى والنوازل خاصة تخريج الفروع على الفروع، الذي بدوره يتفرع إلى عدة أقسام لعل أهمها وأعلاها التخريج على القواعد الفقهية، ورغم عظم نفع هذا الفن إلا أنه لم يلق كبير عناية عند الإمام البرزلي، ولإجلاء النظر عن حقيقة هذا الصنف وبيان أهميته جعلت محور هذه الدراسة يدور حول منهج الإمام البرزلي في التخريج الفقهي، من خلال كتابه "الفتاوى" واقتضت منهجية البحث أن أعرف بـ علم التخريج وأنواعه، ودراسة شروط مجتهد التخريج ومدى تحققها في شخص الإمام البرزلي، مع سوق نماذج عملية مختارة من تخريجه للنوازل عموما وعلى القواعد الفقهية خاصة، والتي سنتناولها بالتحليل والدراسة Jurisprudential graduation is an important mechanism on which juristic rulings are based in devising new and emerging issues that could not find any text to guide them in their ruling, especially after the end of the era of diligent imams. Therefore, we find that the most common type of graduation adopted in the books of fatwas and obtains is special: In spite of the great usefulness of this art, it did not receive much attention at Al-Imam Al-Barzali, and to clear up the truth of this category and its importance made this study the focus of Al-Imam Al-Barzali's approach to jurisprudential graduation through his book "Fatwas". The research methodology required me to know: The science and types of graduation, the study of the conditions of a diligent graduate and the extent to which they are achieved in the person of Imam Al-Barazali, and the market of selected practical models of his graduation in general and in particular in jurisprudence, which we will discuss in analysis and study.
