الّإجماع بعد سبق الخلاف : دراسة تطبيقية

Abstract

تعد مسائل الإجماع من أهم مسائل علم أصول الفقه، ومن هذه المسائل مسألة وقوع الإجماع بعد خلاف سابق، والتي يهدف هذا البحث إلى توضيحها، وذلك من خلال دراسة نماذج لأحكام وقع فيها إجماع بعد خلاف دراسة تطبيقية، للخروج بحكم عام على حجيته وإمكانية وقوعه، وتبين من نتائج هذا البحث أن الإجماع بعد سبق الخلاف قد وقع، وأنه حجة على الصحيح فقد نقله واستدل به جمع من أهل العلم من مذاهب مختلفة Consensus after a previous disagreement among Muslim scholars is one of the most important consensus issues that the science of Usul Alfiqh (the principles of Islamic jurisprudence) deals with. The present empirical study explains Muslim scholars' consensus after a previous disagreement by examining examples of rulings that were unanimously accepted by Muslim scholars after being a subject of disagreement. The study aims to justify the legitimate reference to this type of consensus in Islamic law and establish its authority. It was concluded that this type of consensus is an authority as it occurred in the past and was used by Muslim scholars of different schools as an argument.
