الحق في اللجوء بين الشريعة الإسلامية والاتفاقية الخاصة بوضع اللاجئين لسنة 1951

Abstract

إن الحق في الحصول على ملجاً آمن أي الحق في اللجوء، هو من حقوق الإنسان التي أكدت عليها مختلف المواثيق الدولية، وفي مقدمتها الإعلان العالمي لحقوق الإنسان المادة 14 منه، ومن بعده إعلان القاهرة حول حقوق الإنسان في الإسلام (المادة 12 منه) وقبلهما الشريعة الإسلامية، التي جاءت العديد من الآيات القرآنية والأحاديث النبوية لتؤكد على هذا الحق. بمقارنة أحكام اللجوء في الشريعة الإسلامية مع الاتفاقية الخاصة بوضع اللاجئين لسنة 1951، تتضح العديد من أوجه التوافق بينهما، في مقابل بعض نقاط الاختلاف. كما أن أحكام الشريعة الإسلامية أكثر إحاطة وتنظيما لقواعد اللجوء مقارنة بقواعد اتفاقية 1951، بل أن أغلب قواعد اللجوء يعود أصلها للشريعة الإسلامية The right to a safe refuge, or the right to asylum, is a human right affirmed by various international covenants, starting with the Universal Declaration of Human Rights (Article 14 thereof), and then the Cairo Declaration on Human Rights in Islam (Article 12 thereof) And before them the Islamic Sharia Law in which Quranic verses and hadiths confirm this right. Comparing the provisions of asylum in Islamic Sharia Law with the Convention relating to the Status of Refugees of 1951, many aspects of their compatibility are clear against some points of difference. Also, the provisions of Islamic Sharia Law are more informative and regulating of the rules of asylum compared to the rules of the 1951 Convention, and most of the rules of asylum are indeed rooted in Islamic Sharia Law.
