الحماية المدنية للتجارة الالكترونية - دراسة مقارنة بالفقه الإسلامي

Abstract

تعالج الأطروحة إشكالية الحماية المدنية للتجارة الإلكترونية في التشريع الجزائري، مبرزةً الجهود المبذولة لتوفير الحماية قبل التعاقد وأثناءه وبعده، مع بيان ما يشوب هذا الإطار من تأثر بالتصورات التقليدية وقصور في استيعاب خصوصية البيئة الرقمية. كما تقارن ذلك بتصورات الفقه الإسلامي القائمة على منع الغرر والضرر وحفظ الحقوق، وإمكانية تكييف مفاهيمه مع العقود الإلكترونية. وتخلص الدراسة إلى وجود تقاطع في المبادئ العامة بين النظامين مع اختلاف في الآليات، مؤكدةً ضرورة تطوير القواعد بما يواكب المعاملات الرقمية. وقد اعتمدت المنهج الوصفي والاستقرائي إلى جانب التحليلي والمقارن والاستدلالي. This dissertation addresses civil protection in e-commerce as a key legal challenge in the digital era. It examines the Algerian legal framework, highlighting protection mechanisms before, during, and after contracting, while noting its continued reliance on traditional concepts and its insufficiency in fully addressing the specific nature of electronic contracts. In contrast, Islamic jurisprudence offers adaptable principles grounded in the prevention of gharar and harm, which can be applied to digital transactions. The study reveals convergence between both systems in core principles such as free will, good faith, and compensation, though they differ in mechanisms. It concludes that effective protection requires further legal development and adaptation to modern digital realities, using a descriptive, inductive, analytical, comparative, and inferential methodology.
