وسائل ترسيخ الثقافة القانونية في النموذج الإسلامي ودورها في بناء الحضارة الإسلامية

Abstract

لقد اتسم النموذج الإسلامي بغرس ثقافة قانونية متميزة لدى الفرد المسلم عملت بشكل كبير في تكوين شخصية حضارية، ساهمت في بناء حضارة إنسانية خالدة وتحقيق الشهود الحضاري بامتياز، ولقد تميزت الثقافة القانونية في النموذج الإسلامي عن غيرها من التشريعات الوضعية من خلال وسائل تميزت بالفعالية والإيجابية كان لها الدور الكبير في التطور الذي شهدته الحضارة الإسلامية، فهي قبل أن تكون سلوكا يوميا إجباريا للإنسان فهي جزء من عقيدته وإيمانه، فيلتزم بها عن طواعية واختيار لإرضاء خالقه قبل الناس فهي ثقافة دينية وإنسانية بامتياز ، فلم يكن ترسيخ هذه الثقافة بوسائل إلزامية فقط ؛ بل كانت تتم بوسائل ترغيبية وأصبحت اقتناعا ذاتيا لدى كل فرد بضرورة الالتزام بالأحكام التي يفرضها المشرع القانوني. The Islamic Model was featured by the instillment of a distinct legal culture in the Muslim individual. It has greatly contributed to the formation of a civilized personality that contributed to the building of an immortal human civilization and a significant achievement of the civilized recognition. The legal culture in the Islamic model was distinguished from other status legislations through effective and positive means that owns the great contribution to the development in the Islamic civilization. Before being a daily obligatory behavior for humans, it is seen as a part of their faith and doctrine to which they adhere it voluntarily and by choosing to satisfy their creator rather than people, therefore, it is, distinctively, a religious and humanitarian culture. The consolidation of this culture was not realized only through compulsory means, but also through means of induction, and it became, thereafter, a self-conviction for each individual through the need to comply with its provisions imposed by the legal legislator.
