التفريق القضائي بين الزوجين في الفقه الإسلامي

Abstract

تتناول رسالة الماجستير، دراسة فقهية تأصيلية لآلية التدخل القضائي لحل النزاعات الأسرية المستعصية عندما يتعذر استمرار الحياة الزوجية ويتأكد الضرر. وتتمحور مشكلة الدراسة حول تحديد الضوابط الشرعية والحالات الدقيقة التي يحق فيها للقاضي تفكيك عقد الزوجية دفعاً للمفاسد والسلبيات الاجتماعية الخطيرة الناتجة عن الشقاق، وموازنة ذلك بين كونه علاجاً اضطرارياً أخيراً وبين الحفاظ على حقوق أفراد الأسرة وخاصة الأبناء؛ حيث تسعى الرسالة إلى استقصاء وتفصيل الأحكام الفقهية المتعلقة بأسباب التفريق القضائي (كالعيوب، والغيبة، وعدم الإنفاق، والضرر) وتكييفها بما يضمن تحقيق المقاصد الشرعية في تحقيق العدالة والاستقرار الأسري. The master's thesis presents a foundational jurisprudential study on the mechanism of judicial intervention to resolve intractable family disputes when the continuation of marital life becomes untenable and harm is proven. The core problem of the study revolves around defining the specific legal criteria and cases in which a judge is authorized to dissolve the marital contract, thereby averting the severe social harms and negative repercussions resulting from discord. It balances this intervention as an ultimate necessary remedy against the preservation of the rights of family members, particularly children. Accordingly, the thesis seeks to investigate and detail the jurisprudential rulings pertaining to the grounds for judicial separation (such as defects, absence, non-maintenance, and harm) and adapt them in a manner that ensures the realization of Sharia objectives (Maqasid) in achieving justice and family stability.
