Abstract

تتناول رسالة الماجستير، دراسة أصولية وفقهية تأصيلية لواحدة من أبرز خصائص ومميزات الشريعة الإسلامية وصلاحيتها لكل زمان ومكان. وتتمحور مشكلة الدراسة حول تحديد الحدود والضوابط الفاصلة بين الأحكام قطعية الثبوت والدلالة التي تتسم بالثبات المطلق ولا تقبل التبديل (كالعبادات والمقدرات)، وبين الأحكام الظنية والاجتهادية التي تقبل التغير والمرونة تَبَعاً لتغير الأزمان والمصالح والأحوال والمواطن، وموازنة ذلك لحماية الشريعة من الجمود من جهة، ومن التميع والتحلل باسم التجديد من جهة أخرى؛ حيث تسعى الرسالة إلى بيان كيفية جمع المنهج الإسلامي بين عنصري الثبات والتغير كخصيصة فريدة تضمن استيعاب مستجدات العصر ومواءمة الظروف المستقبلية في إطار المقاصد الشرعية الكلية The master's thesis presents a foundational jurisprudential and doctrinal (Usuli) study of one of the most prominent characteristics and features of Islamic Sharia, namely its applicability to every time and place. The core problem of the study revolves around defining the boundaries and criteria that separate definitive rulings in terms of authenticity and meaning (Qat'iyyat al-Thubut wa al-Dalalah)—which are characterized by absolute constancy and are immutable (such as acts of worship and prescribed legal amounts)—from presumptive and discretionary rulings (Zanniyyat wa Ijtihadiyyat)—which allow for flexibility and change in response to changing times, public interests, circumstances, and contexts. It balances this to protect Sharia from stagnation on one hand, and from dilution and dissolution under the guise of renewal on the other. Accordingly, the thesis seeks to demonstrate how the Islamic approach harmonizes the elements of constancy and change as a unique characteristic that ensures the assimilation of modern developments and adaptation to future circumstances within the framework of the overarching objectives of Sharia (Maqasid)
