عائشة أم المؤمنين - رضي الله عنها - و منهجها في الاجتهاد

Abstract

تتناول رسالة الماجستير، دراسة فقهية وأصولية تأصيلية للدور العلمي والاجتهادي البارز للسيدة عائشة رضي الله عنها كنموذج ريادي للمرأة الفضلى والمجتهدة في صدر الإسلام. وتتمحور مشكلة الدراسة حول استجلاء الملامح المنهجية والقواعد الأصولية التي اعتمدت عليها أم المؤمنين في استنباط الأحكام الشرعية، ورصد دقتها العلمية في نقد المرويات والآراء الفقهية لمعاصريها من الصحابة استناداً إلى القرآن الكريم والسنة النبوية المقاصدية؛ حيث تسعى الرسالة إلى إبراز عبقريتها الفقهية ومكانتها الاستشارية والتعليمية في المجتمع الإسلامي الأول، وتقييم أبعاد منهجها النقدي والاجتهادي في إثراء الفكر الأصولي وتعميق الفهم التشريعي المعاصر The master's thesis presents a foundational jurisprudential and doctrinal (Usuli) study of the prominent scholarly and juristic role of Sayyidah Aisha (may Allah be pleased with her) as a pioneering model of the virtuous and intellectual woman in early Islam. The core problem of the study revolves around elucidating the methodological features and legal principles upon which the Mother of the Believers relied in deducing Sharia rulings, as well as monitoring her scholarly precision in criticizing the narrations and jurisprudential opinions of her contemporary Companions, based on the Holy Quran and the teleological (Maqasidi) Prophetic Sunnah. Accordingly, the thesis seeks to highlight her jurisprudential genius and her advisory and educational status in the early Islamic society, and to evaluate the dimensions of her critical and analytical approach in enriching fundamentalist thought and deepening contemporary legislative understanding.
