Abstract

تتناول رسالة الماجستير، دراسة تأصيلية ومقارنة لأحد المرتكزات الأساسية للحوكمة الرشيدة وفلسفة الحكم في الإسلام. وتتمحور مشكلة الدراسة حول رصد وفحص الضوابط الشرعية والقانونية التي تكفل للفرد والمجتمع ممارسة الحقوق والواجبات السياسية (كالشورى، والانتخاب، والترشح، وتولي الوظائف العامة، والمعارضة السلمية)، وموازنتها بالأنظمة الديمقراطية والوضعية المعاصرة؛ حيث تسعى الرسالة إلى إبراز الشمولية والسبق التشريعي للنظام السياسي الإسلامي في صيانة كرامة الإنسان وحريته الملتزمة، وتقديم رؤية تأصيلية تضمن التوازن بين استقرار سلطة الدولة من جهة، وتمكين الأمة من أداء دورها المحوري في الرقابة وصناعة القرار السياسي من جهة أخرى The master's thesis presents a foundational and comparative study of one of the basic pillars of good governance and the philosophy of ruling in Islam. The core problem of the study revolves around monitoring and examining the Sharia and legal regulations that guarantee the individual and society the exercise of political rights and duties (such as consultation/Shura, election, candidacy, holding public office, and peaceful opposition), and balancing them against contemporary democratic and positive systems. Accordingly, the thesis seeks to highlight the comprehensiveness and legislative precedence of the Islamic political system in safeguarding human dignity and committed freedom, and to present a foundational vision that ensures a balance between the stability of state authority on one hand, and empowering the nation (Ummah) to perform its pivotal role in oversight and political decision-making on the other..
