أثر القواعد الأصولية اللغوية في استنباط أحكام القرآن

Abstract

تتناول رسالة، دراسة أصولية وتطبيقية معمقة لواحدة من أدق قضايا علم أصول الفقه، وهي تفاعل اللسان العربي مع النص الشرعي. وتتمحور مشكلة الدراسة حول رصد وفحص القواعد والضوابط اللغوية التي وضعها الأصوليون لفهم الخطاب، وتتبع أثرها المباشر والعملي في استنباط الأحكام الفقهية من الآيات القرآنية، مع التركيز على دلالات الألفاظ (كالأمر والنهي، والعموم والخصوص، والإطلاق والتقييد)؛ حيث تسعى الرسالة إلى بيان السبق المنهجي لأصوليي الإسلام في وضع نظرية متكاملة لتحليل الخطاب، وإبراز كيف يشكل البناء اللغوي مرجعية حاسمة لضبط الاجتهاد ومنع الانحراف في تأويل النص القرآني، مما يثري الفكر الأصولي المعاصر The thesis presents an in-depth doctrinal (Usuli) and applied study of one of the most precise issues in the science of jurisprudence (Usul al-Fiqh), namely the interaction of the Arabic tongue with the Sharia text. The core problem of the study revolves around monitoring and examining the linguistic regulations and principles established by fundamentalist jurists to understand discourse, and tracing their direct and practical impact on deducing jurisprudential rulings from Quranic verses, with a specific focus on the implications of words (such as command and prohibition, generality and specificity, and absolute and qualified expressions). Accordingly, the thesis seeks to demonstrate the methodological precedence of Islamic fundamentalists in developing an integrated theory for discourse analysis, and to highlight how the linguistic structure constitutes a decisive reference for regulating independent reasoning (Ijtihad) and preventing deviation in interpreting the Quranic text, thereby enriching contemporary doctrinal thought.
