ضوابط السوق في النظام الاقتصادي الإسلامي

Abstract

تتناول رسالة الماجستير، دراسة اقتصادية وتأصيلية وفقهية معمقة لآليات تنظيم السوق وضمان استقراره في المنظور الإسلامي. وتتمحور مشكلة الدراسة حول استقراء القواعد والضوابط الشرعية والأخلاقية التي تحكم المعاملات التجارية والأنشطة التبادلية داخل السوق، والبحث في مدى كفايتها لتحقيق التوازن الاقتصادي والعدالة الاجتماعية، مع رصد دور الدولة وأجهزتها الرقابية (مثل نظام الحسبة) في منع الاحتكار، والغش، والتلاعب بالأسعار، وحماية حقوق المستهلكين والمنتجين على حد سواء؛ حيث تسعى الرسالة إلى تقديم رؤية إسلامية متكاملة تبرز مرونة وكفاءة الاقتصاد الإسلامي في تنظيم الأسواق ومواجهة الاختلالات الهيكلية والأزمات المعاصرة مقارنة بالنظم الوضعية الرأسمالية والاشتراكية The master's thesis presents an in-depth economic, foundational, and jurisprudential (Fiqhi) study of the mechanisms of market regulation and ensuring its stability from the Islamic perspective. The core problem of the study revolves around exploring the Sharia and ethical rules and regulations that govern commercial transactions and exchange activities within the market. It examines their sufficiency in achieving economic balance and social justice, while monitoring the role of the state and its regulatory bodies (such as the Hisbah system) in preventing monopoly, fraud, and price manipulation, and protecting the rights of both consumers and producers alike. Accordingly, the thesis seeks to present an integrated Islamic vision that highlights the flexibility and efficiency of the Islamic economy in regulating markets and confronting structural imbalances and contemporary crises, in comparison to capitalist and socialist positive systems.
