استخراج الأصول الفقهية من الجامع الصحيح للإمام البخاري

Abstract

تتناول هذه الرسالة النيل لدرجة الماجستير موضوع "استخراج الأصول الفقهية من الجامع الصحيح للإمام البخاري". تهدف الدراسة عبر منهج وصفي تحليلي إلى الكشف عن الملامح الأصولية ومنهج الاستدلال والاجتهاد المطلق لدى الإمام البخاري من خلال تراجم أبواب جامعه الصحيح، مبرزةً نبوغه ومكانته الفقهية التي تضاهي إمامته في الحديث. وقد قُسّمت خطة البحث إلى بابين رئيسين؛ خُصص الباب الأول للدلالات وقواعد الاستنباط اللغوية (مثل العموم والخصوص، الإطلاق والتقييد، الأوامر والنواهي، والمنطوق والمفهوم)، بينما ركّز الباب الثاني على الأدلة الشرعية الأربعة (الكتاب، السنة، الإجماع، والقياس) وتطبيقاتها الاجتهادية من واقع فروع الجامع الصحيح This Master’s thesis addresses the topic "Extracting Jurisprudential Principles (Uṣūl al-Fiqh) from the Jāmi‘ al-Ṣaḥīḥ of Imām al-Bukhārī." Employing a descriptive-analytical approach, the study aims to uncover the uṣūl-based features, methodology of inference, and independent legal reasoning (Ijtihād Muṭlaq) of Imām al-Bukhārī through the chapter headings (Tarājim) of his Ṣaḥīḥ, highlighting his brilliance and jurisprudential status, which rivals his leadership in Hadith. The research plan is divided into two main chapters: The First Chapter is dedicated to linguistic implications and rules of deduction (such as the general and the specific, the absolute and the qualified, commands and prohibitions, and the explicitly stated and the implied meaning). The Second Chapter focuses on the four primary legal sources (the Quran, the Sunnah, Consensus, and Analogical Reasoning) and their jurisprudential applications within the branches of the Jāmi‘ al-Ṣaḥīḥ
