Abstract

تتناول هذه الدراسة الأكاديمية، أحكام الفتوى وتطورها وعوامل تغيرها تبعًا لتغير الأزمنة والأمكنة، وتنقسم الرسالة إلى بابين؛ يسلط الأول الضوء على الفتوى في التراث الفقهي من حيث مفاهيمها، وأركانها (المفتي والمستفتي ومستند الفتوى)، والفرق بينها وبين الحكم القضائي، مع رصد لمحة تاريخية عن نشوئها، بينما يركز الباب الثاني على لُبّ الموضوع المتمثل في دراسة العوامل الأساسية المؤثرة في تغير الفتوى كالمصلحة، والعرف، وفساد الزمان، والتطور، بالإضافة إلى دراسة المؤثرات الإضافية (الطبيعية والنفسية والسياسية) التي تحيط بالمفتي وتنعكس على طبيعة فتاواه؛ مبرزةً مرونة الشريعة الإسلامية وصلاحيتها لكل زمان ومكان وقدرتها على استيعاب المستجدات وتحقيق مصالح العباد. This academic study addresses the rulings of fatwas, their evolution, and the factors behind their alteration in accordance with the changing of times and places. The thesis is divided into two sections; the first sheds light on fatwas within the jurisprudential heritage in terms of their concepts, pillars (the mufti, the petitioner, and the basis of the fatwa), and the distinction between them and judicial rulings, while providing a historical overview of their inception. Meanwhile, the second section focuses on the core theme of the subject, which is the study of the primary factors influencing the alteration of fatwas, such as public interest, custom, corruption of the times, and development, in addition to studying the supplementary factors (natural, psychological, and political) that surround the mufti and influence the nature of their fatwas—highlighting the flexibility of Islamic Sharia, its applicability to every time and place, and its capacity to accommodate new developments and realize the best interests of people.
