الحكم الشرعي بين منهج الإستنباط و فقه التنزيل

Abstract

تناقش هذه الرسالة الأكاديمية إشكالية الربط بين النصوص الشرعية والواقع الإنساني المتغير، من خلال ضبط العلاقة بين منهج استنباط الأحكام الشرعية من مصادرها الأساسية وفقه تنزيلها ومراعاتها للواقع الإنساني. وتهدف الدراسة إلى إبراز الشمول التشريعي للرسالة الخاتمة وقدرتها المستمرة على استيعاب مستجدات الحياة وحركيتها المتجددة دون الإخلال بأصالة النصوص الشرعية أو إهمال التطور الاجتماعي. ولتحقيق هذا المنهج، اعتمد الباحث على التكافؤ والتكامل بين مقاصد الشارع، والمنهج التشريعي للخطاب الإلهي، والفطرة الإنسانية؛ مع التأكيد على ضرورة الاستفادة الواعية من التراث الفقهي للسلف وفق ظروفه العلمية والاجتماعية دون جمود، بما يضمن فاعلية الاجتهاد وملاءمته لمآلات الأحكام في الواقع المعاصر. his academic thesis discusses the problem of linking legal/religious texts (Nusus) with changing human reality by establishing a balance between the methodology of extracting Sharia rulings (Istinbat) from their primary sources and the jurisprudence of their contextual application (Fiqh Al-Tanzil). The study aims to highlight the legislative comprehensiveness of the final Message and its ongoing capacity to accommodate life's developments and evolving dynamics without compromising the authenticity of sacred texts or neglecting social evolution. To achieve this approach, the researcher relied on the integration and harmony between the Lawgiver's objectives (Maqasid Al-Shari'ah), the divine discourse's legislative methodology, and human nature (Fitrah). Furthermore, the study emphasizes the necessity of engaging consciously with the classical jurisprudential heritage of predecessor scholars within its scientific and social contexts—avoiding rigidity—to ensure the efficacy of independent reasoning (Ijtihad) and its suitability for the practical outcomes of rulings in contemporary reality.
