تنظيم النشاط السمعي البصري في التشريع الجزائري

Abstract

تهدف هذه الدراسة إلى وصف واقع تنظيم النشاط السمعي البصري في الجزائر، من خلال استعراض تطور حرية ممارسة هذا النشاط في الجزائر، والنصوص المنظمة له، فقد أحاط المشرع الجزائري ممارسة النشاط السمعي البصري بجملة من الضوابط القانونية، منها ما جاء على شكل ضوابط للترخيص بممارسة النشاط السمعي البصري، ومنها ما جاء على شكل شروط تحدد الشكل القانوني للمؤسسة المالكة، وجاءت بعض الضوابط في شكل قواعد تفرض على الهيئة المالكة والمسيرة للمؤسسة السمعية البصرية، كما جاءت في شكل التزامات تفرض على محتوى البرامج، وعلى برمجتها وكيفيات بثها، حيث لجأنا أثناء عرض هذه الضوابط إلى استقراء النصوص التشريعية المنظمة لهذا النشاط. Abstract: This study aims at describing the reality of the organization of audiovisual activity in algeria by reviewing the evaluation of the right to practice this activity and texts regulating it in which the algerian legislator has taken the practice of audiovisual activity by a set of controls.some of these came in the form of controls for licensing of the audiovisual activity ,others in the form of conditions that determine the legal form of the institution of the ownership. It came also in the form of liabilities and their programming and how to broadcast them.In presenting these colntrols, we extrapolated the legistrative texts governing this activity.
