Abstract

تستهدف هذه الدراسة، إبراز الدور الذي يلعبه شرط إستبعاد التعديلات التي تطرأ على القانون الواجب التطبيق على عقود الدولة، و التي تبرم بين الدولة بوصفها سلطة عامة و شخص خاص تابع لدولة أخرى، في الحفاظ على التوازن المالي للعقد، من لحظة إبرامه حتى تمام تنفيذه، لإنجاح عملية الإستثمار. Summary : This study aims to highlight the role played by the condition of excluding the amendments, which is happens on the law applicable to State contracts, which is concluded between the State as a public authority and a private person of another State, in maintaining the financial balance of the decade from the moment of its conclusion until its completion, for the success of the investment process.
