عقد الإيجار الفلاحي الوقفي الناجم عن تحويل حق الانتفاع الدائم أو الامتياز في ظل المرسوم التنفيذي 14/70والقرار الوزاري المشترك المؤرخ في 20/09/2016

Abstract

جاء المرسوم التنفيذي 14/70 المتعلق بإيجار الأراضي الوقفية المخصصة للفلاحة بنموذج متميز لعقد الإيجار ناتج عن تحويل حق الانتفاع الدائم أو حق الامتياز ، ويرد على الأملاك الوقفية المخصصة للفلاحة التي استرجعتها الدولة ، حيث نظم المشرع الجزائري أحكام هذا العقد الخاص ضمن المرسوم التنفيذي 14/70 بأحكام ونصوص قانونية خاصة ، أعقبتها نصوص توضيحية تناولت كيفيات تحويل حق الانتفاع الدائم أو حق الامتياز إلى حق إيجار تضمنها القرار الوزاري المشترك المؤرخ في 20/09/2016 أبرزت دور عقد الإيجار الخاص كصيغة استثمارية متميزة للأملاك الوقفية الفلاحية وأحد الوسائل التنموية في المجال الفلاحي كقطاع اقتصادي مهم للدولة. The executive Decree n: 14/70 on the rent of endowment land for agriculture includes a distinctive lease model, with an organized set of provisions, resulting from the conversion of the right of permanent tenure or concession. It is followed by explanatory texts dealing with the modalities of converting the permanent tenure or concession into a lease right contained in the Joint Ministerial Decision of 20/09/2016. They highlights the important role of private lease as a distinct investment formula for the agricultural endowment properties and one of the main developmental means in the agricultural field, an important economic sector of the state.
