عقد الbot توجه للحداثة لإقامة مشاريع البنية التحتية في الجزائر

Abstract

لقد مارست الدولة الجزائرية منذ زمن أساليب تقليدية كلاسيكية لتسيير المرافق العامة وبرزت بدورها الفعال كدولة متدخلة لتحقيق التنمية والنهوض بالاقتصاد الوطني،واهتمت بإقامة مرافق عامة تلبي حاجة المواطنين،ولكن ضعف القدرات المالية أدى بها إلى التخلي تدريجيا عن هذا الدور والسعي لإيجاد وسائل و أساليب مستحدثة لإقامة هذه المرافق، بعد ان كانت هي المسير الوحيد لها عن طريق الاستغلال المباشر أو أسلوب المؤسسة العامة بالاعتماد على التمويل من الخزينة العمومية،فعقد البناء والتشغيل ونقل الملكية الـBOT هو احد الأساليب المستحدثة لإقامة المرافق ومشاريع البنية التحتية، يقوم على أساس منح القطاع العام للقطاع الخاص مهمة إدارة مرفق عام والنهوض به لمدة مدونة بالعقد المتفق عليه بين الطرفين،معالاحتفاظ بملكيته لصالح القطاع العام،ولقد لقي هذا النظام رواجا كبيرا في العديد من الدول على غرار الجزائر التي لم تتبنى هذا النظام بشكل فعال إلا ما جاء في صيغة امتياز. ABSTRACT The Algerian state has practicedtraditional methods since ages to manage public utilities and emerged in turn as anintervening country to achieve development and advancement of the national economy and was interested in the establishment of public facilities that meet theneeds of citizens , how ever due to itsfinancial vulnerability have led it to abandon that role and seek new ways and means to establish those facilities he direct exploitation or in the form of a public institution that is based on funding from the public treasury thus ,the contract of construction, operation and transfer of ownership BOT is one of the modern methods of establishing infrastructure facilities and projects . it is therefore based on the granting of the public sector, to the private one,the task of managinga public facility and promoting it for a duration mentionedin the contract agreed upon between the two parties sides white retaining ownership of it for the lunefit of the public sector this system has been very popular in many countries like Algeria which did riot adopt it effectively except in privileged cases .
