علة قتل المرتد في الإسلام من خلال نصوص الكتاب و السنة

Abstract

بحثنا عن علة عقوبة المرتد عن الإسلام بالقتل؛ فمن العلماء من رأى أن العلة هي ترك الدين و الخروج منه إلى دين آخر أو إلى لا دين ، و فريق من العلماء رأوا أن من ترك دينه يُستتاب و يُعزّر ؛ و لا يقتل و استدل كل فريق بأدلة من القرآن و السنة ؛ و لكن بعد التأمل في النصوص و جدنا أن كل الحالات التي أمر فيها النبي صلى الله عليه وسلم بقتل المرتد و ما فعله الخلفاء و الأمراء من الصحابة عليهم الرضوان كان بسبب تلبس الارتداد بالعدوان ولهذا لافرق في الحكم بالقتل بين من كان كافرا ثم أسلم ثم ارتد و الذي ولد مسلما و نشأ في بيئة مسلمة ثم ارتد إن كان كلاهما يريد عدوانا بقول أو فعل . Summary: We looked for the reason for the punishement of the apostate from islam by killing , some of the scholars believed that the reason is leaving one religion and leaving it to another religion , or to no religion , and a group of scholars saw that abstaining from his religion is repented and excused and not killed, and each team inferred with evidence from quran and the sunnah , but after looking at the texts , we found that all the cases in which the prophet may god bless him and grant him peace , ordered the killing of the apostate , and what the caliphs and princes among the campanions , upon them al radwan was due to apostasy with aggression , and this is why there is no difference between one who was an unbeliever then converted to islam, then converted , and one who was born a muslim, grew up in a muslim environment , then converted in sentencing them wanted aggression by word or deed.
