Abstract

الدستور كنظام قانوني ما هو إلا منتجا للإرادة الشعبية ،وهو أحد أهم المفاهيم الأساسية التي تقوم عليها المؤسسات السياسية ،لتكون نصوص الدستور ولغته ومفاهيمه تعبر عن الحياة السياسية وتخضعها لقواعد معينة كما أن قراءة أولية لبيان أول نوفمبر يشعر فعلا بروح الوطنية والدفاع بالنفس والنفيس عن الجزائر وأن الشعب التحم لأجل بلد العزة والكرامة ،لذلك ظلت الثورة التحريرية رمزا لا يمكن المساس بها أو بشهدائها فهي الماضي والحاضر والمستقبل ويشكل الأمة الجزائرية ومنه كان السند لوضع دستور الدولة الجزائرية الحرة الأبية The constitution as a legal system is nothing but a product of the popular will, and it is one of the most important basic concepts upon which political institutions are based, so that the texts, language and concepts of the constitution express political life and subject it to certain rules. A preliminary reading of the November 1st statement reveals the spirit of patriotism, self-defense, and self-sacrifice for Algeria, and that the people have united for the sake of a country of pride and dignity .Therefore, the liberation revolution remained a symbol that cannot be touched, nor its martyrs, for it is the past, present, and future that shaped and shapes the Algerian nation, and from it was the basis for drafting the constitution of the free and proud Algerian state.
