متطلبات تفعيل الوسائل البديلة لتسوية منازعات الصيرفة الإسلامية في الجزائر-التحكيم أنموذجا-

Abstract

حاولت السلطات الجزائرية توطين الصيرفة الإسلامية في الجزائر من خلال فتح المجال لممارسة نشاط الصيرفة الإسلامية من خلال مؤسسات مصرفية محلية، الأمر الذي انبثق عنه تأسيس العديد من النوافذ أو الشبابيك الإسلامية في الجزائر، وفي طل منظومة قضائية تقليدية في الجزائر وانعدام الخبرة والتشريعات المناسبة، الأمر الذي يضع هذا النشاط في مواجهة تحديات المنازعات المصرفية الإسلامية مستقبلا. وفي هذا الصدد تم طرح عدة بدائل لتسوية المنازعات خارج القضاء المندرجة ضمن نشاط الصيرفة الإسلامية سواء على مستوى البنوك الإسلامية أو حتى الشبابيك أو النوافذ الإسلامية، حيث تم التركيز على أهم بديل وهو التحكيم المصرفي الإسلامي، ومحاولة تحليل متطلبات تفعيله في الجزائر. ABSTRACT: The Algerian authorities tried to localize Islamic banking in Algeria by opening the way for practicing Islamic banking activity through local banking institutions, which resulted in the establishment of many Islamic windows or windows in Algeria, and in the light of a traditional judicial system in Algeria and the lack of experience and appropriate legislation, which puts this activity in the face of the challenges of Islamic banking disputes in the future. In this regard, several alternatives were proposed for settling disputes outside the judiciary that fall within the scope of Islamic banking activity, whether at the level of Islamic banks or even Islamic windows or windows, where the focus was on the most important alternative, which is Islamic banking arbitration, and an attempt was made to analyze the requirements for its activation in Algeria.
