الدّراسة اللّغويّة ودورها في بيان دلالات وأحكام الأحاديث النّبويّة "حديث تنكح المرأة لأربع أنموذجا"

Abstract

البحث يتناول الدراسة اللغوية ودورها في بيان دلالات وأحكام الأحاديث النبوية، وقد كان حديث تنكح المرأة الأربع أنموذجا لهذه الدراسة، وتكمن أهمية الموضوع في ربط النصوص الشرعية بجوانبها اللغوية، قصد استثمار الإمكانات اللغوية في خدمة النص الشرعي وما يرمي إليه من مقاصد وأهداف ولهذا فإنّ إشكالية البحث تتمثل في مدى الأثر الذي تتركه الدراسة اللغوية في توجيه وبيان دلالات النص النبوي، والدور المنوط بتلك الدراسة في تجلية واستنباط الأحكام من النص النبوي، وقد كانت المعالجة في ثلاثة محاور؛ اللغة في دراسة الأحكام الشرعية واللغة والحديث النبوي، ودراسة حديث تنكح المرأة لأربع، وقد أسفر البحث على نتائج، منها: أن الدراسة اللغوية في تعاملها مع النص النبوي، تحتاج لأمور ، منها : المكنة اللغوية، والإلمام بالعلوم الشرعية، وهذا ما يجعل التركيز على الجوانب اللغوية في التعامل مع النص النبوي من الأمور الضرورية لكشف الدلالات الظاهرة والخفية الموصولة للأحكام الشرعية. The research deals with the linguistic study and its role in the statement of the semantics and provisions of the hadiths of the Prophet, has been the talk of women marry four model for this study, and the importance of the subject lies in linking the legal texts aspects of the language, in order to invest the linguistic potential in the service of the legal text and its objectives and objectives, and for this the problem of the research is the extent of the impact left by the linguistic study in directing and indicating the semantics of the Prophet's text, and the role entrusted to that study in the manifestation and deduction of provisions from the text of the Prophet, has been processing In three axes: language in the study of legal rulings, language and hadith of the Prophet, and the study of the hadith of women marrying for four, and after the study the research resulted in some results, including: that the linguistic study in dealing with the text of the Prophet, need things, the first: the linguistic machine, and the second: familiarity with forensic sciences, and this is what makes focusing on the linguistic aspects in dealing with the text of the Prophet necessary to reveal the apparent and hidden connotations that also have a role in facilitating access to legal rulings.
