Abstract

يعالج هذا المقال موضوع الخنثى وعلامات تحديد جنسه عند فقهاء الشريعة وعلماء الطب، فحدد فقهاء الشريعة عدة علامات كلها ظاهرية، معظمها يظهر بعد البلوغ، في حين إعتمد علماء الطب، علامات كلها باطنية، تشمل الاعضاء التناسلية الداخلية والتركيبات الصبغية والهرمونية والغددية، ونرى أن العلامات التي اعتمدها علماء الطب أرجح وأحسن من تلك التي اعتمدها فقهاء الشريعة، لأنها أوسع واشمل وأدق وليس فيها مجال للشك والتناقض والاستواء، كما أنه يمكن تحديدها في مراحل متقدمة من الحمل، أو بعد الميلاد مباشرة دون انتظار البلوغ. This article deals with the issue of the hermaphrodite, and the signs of determining its sex, according to Sharia jurists and medical scientists. The Sharia jurists identified several signs that are all outward, most of which appear after puberty, while medical scientists have adopted signs internal, including internal genitalia, chromosomal, hormonal and glandular structures, And we see that the signs adopted by medical scientists better than those adopted by Sharia jurists, because they are broader, more comprehensive and more accurate, and there is no room for doubt, contradiction , and they can be identified in advanced stages of pregnancy, or immediately after birth without waiting for puberty
