الفعل الإلتزامي في الدرس الفقهي مقاربة تداولية: قراءة في كتاب تحرير الكلام في مسائل الإ لتزام-

Abstract

يتناول المقال مقاربة تداولية لفعل الالتزام في الدرس الفقهي باعتباره فعلا كلاميا تترتب عليه الحقوق بين الأفراد، ولما كان مفهوم الالتزام متأصلا في علم القانون تدرج المقال في العرض على النحو التالي: تحديد مفهوم الالتزام في الدرس القانوني، ثم بيان أهميته في تأسيس نظرية أفعال الكلام وصياغتها، ثم تحديد مفهوم الأفعال الالتزامية في الدرس التداولي، وتحديد سماتها، لينتهي المقال ببيان مفهوم الالتزام في الدرس الفقهي والكشف عن أبعاده التداولية، من خلال تحديد الفقهاء لأركانه الخطابية، واعتمادهم في تحديده على الإجراءات التداولية، كالقصد، وقرائن الأحوال، وقد كان كتاب " تحرير الكلام في مسائل الالتزام"، لأبي عبد الله محمد بن محمد الرعيني، المشهور بالخطاب، هو الكتاب المعتمد كمدونة للتطبيق والمقاربة. The paper sheds light on a pragmatic approach to the commitment act in the jurisprudent lesson because it is a speech act that results in rights between the individuals. Because the concept of commitment is deeply-rooted in Laws, the paper is structured as follows: determining the concept of commitment in the legal lesson, showing its importance in founding and formulating the speech act theory, determining the concept of the commitment act in the pragmatic lesson and its characteristics, and finally showing the concept of the commitment act in the jurisprudence and revealing its pragmatic dimensions through the jurisprudents’ identification of its bases and their adoption of the pragmatic procedures such as the intention and circumstantial evidence. In this line, the book Tahrir al-Kalam fi Masail al-Iltizam of Abi Abdullah Mohamed Bin Mohamed Al-Raini, known as “al-Khattab” is what we relied on in the application and approach.
