الجرائم السياحية بين تعدد أصنافها والمواجهة التشريعية في القانون الجزائري

Abstract

تهدف هذه الدراسة للوقوف على أهم الجرائم التي ترتكب بمناسبة السياحة سواء على السائح الزائر للبلد أو من طرفه أو على ما يرمز للمعالم السياحية ويطلق عليها بالجرائم السياحية ، وهي عديدة نذكر أهمها وأكثرها شيوعا وتسليما لدى المجتمع الدولي ، ومن ثمة نقف على طرق مكافحتها والتصدي لها من الناحية التشريعية من خلال أهم القوانين الوطنية التي أتى بها المشرع الجزائري في إطار مكافحة هذا النوع من الجرائم خاصة مع تنوع أساليبها وتعدد مرتكبيها نتيجة التطور الذي تشهده المجتمعات اليوم لاسيما في مجالي التكنولوجيا والإعلام ، ومنه نقف على أهم النتائج المتوصل إليها من الدراسة بأنها جريمة مستمرة تستدعي تكاثف كل الجهود الوطنية والدولية والعمل في إطار التعاون القضائي للتصدي لها والحد منها.This study aims to identify the most important crimes that are committed on the occasion of tourism , whether on the tourist visiting the country or by him or what symbolizes tourist attractions and is called tourism crims , and they are numerous we mention the most important and most common and recognized by the international commity. and from there we stand on ways to combat it and address it from the legislative aspect through the most important national laws brought by the Algerian legislator in the context of dealing with this type of crime , especially from the diversity of its methods and the multiplicity of its perpetrators as a result of the development witnessed by societies , especially in the fields of technology and media, and from it we stand on the most important findings of the study that it is a continuous crime that calls for intensifying all national and international efforts and judicial cooperation to confront and limit it
