التعلييل والتقصيد المصلحي في النصوص الشرعية وعلاقته بالنظرية التأويلية المعاصرة -عرض ونقد

Abstract

تبحث هذه المقاربة موضوعاً متعلقاً بتأويل النص الشرعي من خلال بيان المنهج التعليلي المصلحي التقصيدي في تأويل النص الذي أمه كل علماء الإسلام الذين يعتقدون أن النص الشرعي نص خالد مجرد عن حدود الزمان والمكان والإنسان، ومؤهل للإنتاج في كل زمان ومكان، كما أوضح البحث مسالك أصحاب النظرية التأويلية المعاصرة للنص الذين يتذرعون بحرية التعبير أو البحث أو التفكير، ويروجون لدعاوى تستهدف تعطيل النصوص وإجهاضها باسم تاريخية النص أو نسبية الأحكام الشرعية، وختم البحث بقراءة نقدية لهذا المنهج من خلال عرض ضوابط التأويل المقاصدي والمصلحي والتعليلي للنص الشرعي. This approach examines a topic related to the interpretation of the legal text by clarifying the explanatory, reformist and persuasive approach in the interpretation of the text, which is the mother of all Islamic scholars who believe that the legal text is an immortal text abstracted from the limits of time, place and man, and is qualified for production at all times and places. Contemporary interpreters of the text who invoke freedom of expression, research, or thinking, and promote claims aimed at disrupting the texts and aborting them in the name of the historicity of the text or the relativity of the legal rulings.
