تأمين الخطأ الطبي

Abstract

إن الطبيب هو المسؤول الأصلي عن كل الأضرار الناتجة عن أخطائه الطبية إزاء المريض الذي يرجع عليه بجبر الضرر، إلا أن القانون أجاز للطبيب التأمين عن أخطائه الطبية. وعليه من خلال هذه الورقة البحثية، تهدف إلى معالجة ماهية الخطأ الطبي وذلك بإعطاء تعريف لهذا الخطأ وتحديد عناصره وأنواعه وصوره في المحور الأول)، ثم ننتقل إلى معالجة تأمين هذا الخطأ الطبي من خلال إعطاء تعريف لهذا التأمين وتحديد صوره وشروطه والزاميته ونطاقه التأميني في المحور الثاني). وتوصلنا إلى أن الخطأ الطبي هو إخلال الطبيب بأصول مهنة الطب، وهو المسؤول عن هذا الإخلال، إلا أنه يجوز له التأمين عن هذا الخطأ لدى شركات التأمين التي تتكفل في نهاية المطاف بكل التعويضات The doctor is primarily responsible for all damages resulting from his medical errors towards the patient who can claim compensation for the damages, but the law allows the doctor to insure his medical errors. Accordingly through this research paper, we aim to address the nature of medical error by defining this error and identifying its elements, types and forms in (the first axis), then we move on to address the insurance of this medical error by defining this insurance and identifying its forms, conditions, obligation and insurance scope in (the second axis). We concluded that medical error is the doctor’s breach, but he is allowed to insure this error with insurance companies that ultimately cover all compensation.
