معادة الإخوة في الميراث بين الشذوذ الفقهي والاعتبا رات القانونية للتطبيق

Abstract

يتناول موضوع المقال الحالي مسائل المعادة بين الإخوة في الميراث ، وهي من المسائل الشاذة في الفقه الإسلامي ، وذلك بهدف البحث في أسس المذهب القائل بها ومحاولة الوقوف على التوجه التشريعي في قانون الأسرة من خلال الاجابة على اشكالية : كيف يورث القائلون بالمعادة الجد المجتمع مع الإخوة الأشقاء والإخوة لأب في مسألة واحدة وموقف قانون الأسرة الجزائري؟ ومن أهم النتائج المتوصل اليها في البحث أن القول بمسائل المعادة قول فقهي شاذ ، ولكن مع عدم إختيار المشرع الجزائري للمذهب في نص المادة 222 من قانون الأسرة فإنه يمكن للقاضي اللجوء الى تطبيق هذا المذهب الشاذ بشرط احترام مبدأ النظام العام ، ومن جهة أخرى فقد وقفنا على نتيجة هامة وهي أن استعانة الاخوة الاشقاء بالاخوة لأب ثم الرجوع عليهم لأخذ نصيبهم فيه تحايل على احكام الميراث واضرار بالجد والاخوة لأب The topic of the current article deals with the issues of Al-Moàdda between brothers in inheritance, which is one of the abnormal issues in Islamic jurisprudence, with the aim of researching the foundations of the doctrine that says it and trying to identify the legislative orientation in family law by answering the problematic: How do those who say return inherit the grandfather of society with siblings And the father's brothers in one issue and the position of the Algerian family law One of the most important results that were reached in the research is that the issues of return are an abnormal juristic opinion, but with the Algerian legislator not choosing the doctrine in the text of Article 222 of the Family Code, the judge can resort to applying this provided that the principle of public order is respected, and on the other hand, we came to the conclusion It is important that full siblings seek the assistance of the siblings from the father and then refer to them to take their share in the inheritance. It violates the provisions of inheritance and harms the grandfather and the brothers on the father's side.
