Abstract

يعتبر قرار الإسناد إجراء جوهريا يهدف إلى إبرام عقد المحروقات ولئن كان تصرفا منفردا إلا أن اشتراك كل من الوكالة الوطنية لتثمين موارد المحروقات والوزير المكلف بالمحروقات في إصداره قد يطرح اشكالا أمام قاضي الإلغاء، وهو ما يستوجب ضرورة البحث في طبيعته القانونية ومعايير الاختصاص القضائي في النظر في إلغائه. لنصل بذلك إلى كونه قرارا إداريا ينظر فيه قاضي المحكمة الإدارية بالعاصمة مستندا في اختصاصه إلى مرسوم المصادقة الذي يعطيه الطابع التنفيذي وتوقيع (النفط The award decision is considered an essential procedure aimed at concluding a hydrocarbon contract.
