فكرة العدول القضائي الدستوري وأثرها على الأمن القانوني

Abstract

إن القضاء هو أحد أهم ركائز بناء المجتمعات، ذلك أن دفع الظلم وإقامة النظام يعد من صميم عمل القضاة، وبما أن القاضي الدستوري هو مجرد إنسان وبالتالي فهو قد يصيب وقد يخطئ، وبالتالي فإن أحكامه وقراراته قد لا تكون صحيحة وصائبة في جميع الأحوال، وحيث أن أغلب الدساتير المقارنة نصت على أن تكون قرارات وأحكام الجهات المكلفة برقابة الدستورية نهائية وباتة وملزمة لجميع السلطات والهيئات لها حجية مطلقة في مواجهتها ولا تقبل الطعن بأي طريقة من طرق الطعن، مما أتاحللقضاء الدستوري ابتداع طريق ذاتي من أجل تصويب وتصحيح ما قضى به سابقا The judiciary is one of the most important pillars of building societies, as eliminating injustice and establishing order is at the core of the work of judges. Since the constitutional judge is merely a human being, he may be right or wrong, and therefore his rulings and decisions may not be correct and sound in all cases ،Whereas most comparative constitutions stipulated that the decisions and rulings of the bodies charged with constitutional oversight be final, binding on all authorities and bodies, and have absolute authority over them and are not subject to appeal in any way, which allowed the to devise an independent path in order to correct and rectify what it had previously ruled.
