إعمال الفطرة في النظر المقاصدي الموازنة بين المصالح والمفاسد انموذجا

Abstract

تسعى هذه الورقة البحثية إلى تحديد دور الفطرة وكيفية الاحتكام إليها في النظر المقاصدي، وفي الموازنة بين المصالح والمفاسد، ومن ثم استثمارها في الترجيح في النوازل المعاصرة. وقد تم التوصل إلى عدد من النتائج أهمها للفطرة دور محوري في معرفة المصالحوالمفاسد، بل حتى أدقها وأخفاها. ويظهر إعمال الفطرة في النظر المقاصدي في الكثير من التطبيقات القديمة منها والمعاصرة، وقد أمكن جعل الفطرة طرفا في تعضيد الترجيح في بعض المستجدات كزواج المسيار، وكذا عمليات التجميل الكمالية. This paper seeks to determine the role of human instinct and how to invoke it in the intended consideration, in balancing interests and corrupt, thereby investing it in weighting in contemporary issues. A number of conclusions have been reached, the most important of which being: that natural things have a pivotal role to play in knowledge of interests and corrupt, even more precise and hidden. The realization of intentional consideration is reflected in many old and contemporary applications, and the human instinct as a supporter has been made possible in the weighting of some developments such as misyar marriages, as well as perfectionist cosmetic procedures
