Abstract

تعتبر الفتوى الجماعية أو الاجتهاد الجماعي شكلا من أشكال الإخبار الشرعي الذي يستهدف بيان حكم الشريعة الإسلامية من نوازل الأمة وما يستبد بها من وقائع ويستجد فيها من حوادث، ومسلكا مهما لتأمين المجتمع مما يحيق بها من إخطار ويلحقها من أضرار، وحتى يتحقق هذا المقصد تبنت عديد الدول الإسلامية فكرة مأسسة الاجتهاد الجماعي بممارسته من خلال مؤسسات أو هيئات تعرف بالمجامع الفقهية. وأمام التحديات والرهانات التي تواجه المجتمع الجزائري اليوم، والتي تجعله في مواجهة مباشرة مع تأثيرات الواقع المعاصر بصروفه وغيره، تظهر الحاجة إلى تأسيس مجمع فقهي جزائري، وهو ما نستهدفه بالبحث والدراسة، والذي توصلنا من خلاله إلى عدد من النتائج تتجلى إجمالا في إظهار أهمية التأسيس المرجعية دينية مؤسساتية رصينة تعنى بأمر لفتوى الجماعية The collective fatwa or collective jurisprudence is a form of forensic information aimed at the statement of the ruling of Islamic law from the ruling of the umma and the facts that are imposed on it and the new incidents, and an important course of securing society, which is besetting it from the dangers and damages, and until this purpose is achieved, many have adopted Islamic countries are an idea of institutionalizing collective jurisprudence through institutions or bodies known as doctrinal universities.
