الآليات القانونية لمكافحة خطاب الكراهية وفقا للقانون رقم 05/20 من التشريع الجزائري

Abstract

يهدف القانون رقم 05/20 إلى مكافحة خطاب الكراهية وكل ما من شأنه التفرقة والتمييز بين الأفراد، وأيضا كل فعل أو سلوك أو لفظ يؤدي إلى احتقار فرد أو فئة معينة لسبب عرقي أو ديني، أو جنس، وغيرها من صور الاضطهاد، وجاء هذا القانون التعزيز قيم الديمقراطية من جهة وصون الحقوق والحريات وقيم التسامح والاحترام والعمل على احترام حقوق وحريات الإنسان دون تمييز والعمل على سيادة القانون من جهة أخرى، والمشرع بإصداره القانون الوقاية من التمييز وخطاب الكراهية ومكافحتهما يسعى إلى التغيير ودعم الديمقراطية ونبذ التطرف والكراهية والعنف في المجتمع، ليس فقط إصلاح النظام السياسي ومكافحة الفساد في السلطة، إنما الدعوة إلى الوئام الوطني والتكافل بين أفراد الشعب الواحد، سنحاول من خلال هذه الدراسة عرض آليات مكافحة الكراهية وفقا للقانون 05/20.
