الفلاسفة والقانون الطبيعي: عرض تاريخي

Abstract

يعالج هذا البحث فكرة القانون الطبيعي عند الفلاسفة من الناحية التاريخية، هذه الفكرة التي جاءت بعد تأمل طويل نبعاً من الإيمان بوجود قانون كامن في طبيعة الروابط الاجتماعية بين الأفراد والشعوب، خاصة وأن المجتمعات القديمة كانت تنظر إلى هذا القانون نظرة مقدسة مفادها أنه قانون صالح لكل زمان ومكان، فهو ليس من وضع البشر، ولكنه ذو أصل سماوي وقوة عليا، يكشف عنه عقل الإنسان ولا يُوجده، وتكمن أهمية البحث في تسليط الضوء على الاهتمام البالغ الذي أولاد الفلاسفة لفكرة القانون الطبيعي، ومن ثم اعتماده كمصدر أساس في تنظيم العلاقات بين الناس. هذا القانون . من خلال ما توصلنا إليه . تطورت النظرة إليه عبر مر العصور وكر الأزمان، وقد تمت الإشارة خلال هذا البحث إلى أهم المراحل التي مر بها هذا القانون ثم أبرز الأعلام الذين اشتهروا بالبحث في مجال القانون الطبيعي، خاصة في الفكر الفلسفي الغربي This research deals with notion of Philosophers and Natural Law: A Historical View, this notion was the result of long meditation stemming from a belief in the existence of a law that is latent in the nature of social ties between individuals and peoples, this is especially true regarding that ancient societies viewed this law as being sacred and valid for all time and places. And as having a heavenly and a supreme power, reached by human mind. But origin not created by it the importance of the present research lies in coasting light on the exaggerated interest that philosophers gave to natural law and adapting it as a source for regulating relations and spreading between people. The result obtained through this research indicate that views about this law have evolved through times. This research has referred to the most important stages this law went through as well as the most prominent researchers in the field of natural law, mainly western philosophers.
