أسس اللامركزية الإدارية الإقليمية دراسة مقارنة بين النظام الإسلامي والجزائري

Abstract

يتناول البحث أسس اللامركزية الإدارية الإقليمية مقارنة بتطبيقها في الدولة الإسلامية، ويخلص إلى أن المشرع الجزائري تأثر بالتجارب المقارنة، خاصة الفرنسية، من حيث الاعتراف بوجود مصالح محلية مستقلة، وإقرار مبدأ الإدارة المستقلة، مع إخضاع الجماعات الإقليمية لنظام الوصاية. كما يبرز البحث أن الدولة الإسلامية عرفت بدورها هذه الأسس من خلال تنظيم صلاحيات الولاة والرقابة عليهم، غير أن الرقابة فيها كانت تهدف فعليًا إلى احترام مبدأ المشروعية، بخلاف الوصاية المشددة في النظام الجزائري التي تعيق عمل الجماعات الإقليمية. This thesis examines the foundations of regional administrative decentralization in comparison with the model applied in the Islamic state. It concludes that Algerian legislation has been influenced by comparative decentralization models, particularly the French system, through recognizing distinct local interests, establishing independent local administration, and subjecting regional entities to state supervision. While Algeria applies a strict and restrictive form of supervision that hinders local authorities, the Islamic model also practiced oversight over governors, but in a more effective and legitimate manner aimed at ensuring legality and good governance.
