استغلال العقارات الوقفية العامَّة الموجهَّة لإنجاز مشاريع استثمارية كآلية تشريعية لتثمين وتنمية الأملاك الوقفية : دراسة على ضوء أحكام التشريع الجزائري

Abstract

يُشكل العقار الوقفي أحد الآليات الفاعلة التي أثبتت مساهمتها في دفع عجلة التنمية الاقتصادية لاسيما في ظل الانفتاح الاقتصادي الذي رافقه فتح المجال واسعا أمام الاستثمار الوطني والأجني باعتباره أداة لتنمية وتثمين الأملاك الوقفية وضمانة للمحافظة على ديمومتها وحركيتها بما يعود بالنفع على الفرد والمجتمع. وقد أولى المشرع الجزائري مؤخرا أهمية قصوى للاستثمار في هذا النوع من الأملاك الوقفية من خلال تطوير البنية التشريعية المؤطرة لعملية استغلالها لاسيما تلك الموجهة منها لإنجاز مشاريع اقتصادية سعيا منه لتحقيق التنمية الاقتصادية واستقطاب اليد العاملة تزامنا مع الأوضاع الراهنة التي تشهد تزايدا على سوق العمل ، وهو ما جسده المرسوم التنفيذي رقم 213/18 الذي عُد منعرجا حاسما في تجسيد البعد الاستراتيجي لاستغلال العقارات الوقفية العامة الموجهة لإنجاز مشاريع استثمارية. انطلاقا من هذا الطرح تهدف هذه الورقة البحثية إلى تقييم مدى مساهمة استثمار العقارات الوقفية الموجهة لإنجاز مشاريع استثمارية في تثمين الأملاك الوقفية وتنميتها The endowment real estate is considered as one of the most active mechanisms that has proved its contributions in the economic developement mainly in the light of economic openess which accompanied the vast national and foriegn investement which are considered as tools of development and the valuation of endowment properties through the development of the ligislative operation of endowment and its garantee for the sake of the preservation of its permanence and mobility for the benifit of the individual and the society as well . The algerian lisgislator has recently been aware about the importance of the investement in this type of properties through the development of the ligislative structure which conducts its exploitation mainly those which are oriented to for the of achievement of the economic projects for the sake of the development and the attraction of the handlabour conciding with the recent circumstances .which is embodied by the executive decree number : 18/213 tha is considered as a crucial changing point in the imbodiment of the strategic dimensions of general endowment meant for the achievement of invested projects . Based on this proposal, this research paper aims to assess the extent to which the investment of waqf properties directed at the completion of investment projects contributes to the valuation and development of waqf properties.
