الأحكام الشرعية للاشتراك والانفراد في السفر ومقاصدُه

Abstract

تهدف هذه الورقة البحثية إلى دراسة موضوع السفر من حيث الانفراد فيه والاشتراك للرجل والمرأة، عن طريق دراسة تأصيلية ترمي إشكاليتُها الرئيسية إلى الكشف عن الحكم الشرعي لكل حالة من خلال تفصيل أقوال العلماء وسبب الخلاف بينهم في تلك المسائل، مع بيان دليل كل رأي فقهي - بغرض الخلوص إلى القول الراجح في ذلك -، وكذا تسليط الضوء على المقاصد الشرعية للاشتراك في السفر، وقد خلصت الدراسة إلى مجموعة من النتائج أهمّها أنّ اعتبار الاشتراك في السفر له أهداف مقاصدية تشوّفت الشريعة إلى تحقيقها. This research aims to study the topic of travel, whether it is undertaken alone or in partnership for both men and women. It employs an in-depth foundational study whose main objective is to reveal the Islamic legal ruling for each case, by detailing the opinions of scholars and the reasons for their disagreements on these issues, along with presenting the evidence for each jurisprudential view, aiming to reach the most preponderant opinion. The study also sheds light on the legitimate objectives (Maqasid al-Shari'ah) behind travelling in group. The study concluded with a set of results, the most important is that travelling in partnership has intentional objectives that Islamic Shari'ah seeks to achieve.
