Abstract

إن تطور وتعدد المخاطر التي تواجهها المعاملات المالية والإقتصادية المعاصرة أدى إلى تزايد الإهتمام بفكرة الضمانات والتأمينات، ولعل توظيف حق المليكة كضمان يعتبر من أهم الوسائل الإئتمانية المستحدثة، ذلك أن شرط الإحتفاظ بالملكية يمنع نقل الملكية للمدين إلى حين إستيفاء الدائن لحقه، غير أنه وبالرغم من إنتشار شرط الإحتفاظ بالملكية من الناحية العملية غير أن النقاشات الفقهية لا تزال قائمة حول طبيعة وآثاره القانونية وأحكامه في الشريعة الإسلامية. . Abstract: The development and multiplicity of risks facing modern financial and economic transactions have led to a growing interest in the concepts of guarantees and insurance. Perhaps the use of securing rights is the retention of title, which is considered among the most important contemporary credit instruments. as the condition of retention of ownership prevents the transfer of ownership to the debter until the creditor has satisfied his rights. Despite its increasing prevalence and the practical legal necessity for its adoption, the concept of title retention continues to be the subject of ongoing jurisprudential debate, particularly regarding its nature, legal implications and provisions with Islamic jurisprudence.
