دور المقاصد الشرعية في توسيع العلل القياسية - مراجعة أصولية تطبيقية معاصرة -

Abstract

تتناول هذه الدراسة دور مقاصد الشريعة في توسيع نطاق العلّة ضمن الاجتهاد القياسي، وذلك بنقلها من الجزئية إلى الكليّة، وقد عمِلَتْ على بيان هذا التوسيع ومنهجه وإثبات أصالته في الفكر الأصولي، وربطه بالاجتهاد التنزيلي، كما عرضت أهم الضوابط المنهجية لهذا المسلك في ظل محدودية المعالجة الجادّة له في الخطاب الأصولي المعاصر، ومن خلال عرض نموذجين فقهيين معاصرين أبرزت الدراسة البعد الوظيفي للتعليل بالمقاصد ، لتنتهي إلى تأكيد ضرورة وأولوية هذا المنهج مع التنبيه إلى أن المقاصد ليست على مرتبة واحدة وأن بعضها فقط يصلح أساسا للتعليل به. This study explores the role of the higher objectives of Islamic law in expanding the scope of the legal cause within analogical Reasoning, shifting it from the particular of the universal , it explains the concept and methodology of this expansion establishing its authenticity in usuli thought and its link to applied ijtihad , the research outlines key methodological parameters, nothing the limited treatment in contemporary usul al-fiqh, by examining two modern jurisprudential models it demonstrates the functional role of reasoning with maqasid and affirms the necessity of this approach, while stressing that not all objectives are suitable foundations for legal reasoning
